GoAnimate for Schools, provided by GoAnimate, Inc. (“GoAnimate for Schools”, “we”, “us”, or “our”) recognizes the importance of the privacy of children and of all of its users. This COPPA Privacy Policy (“COPPA Policy”) is designed to comply with the federal Children’s Online Privacy Protection Act (COPPA) and contains important information for teachers, parents, and children about how we collect, use, disclose, retain and delete the personal information of users of our website goanimate4schools.com (the “Site”) and the services available through our Site (collectively, the “Services”), including information from children under thirteen (13) years of age and teachers.

While COPPA only applies to personal information collected from children under thirteen (13), GoAnimate for Schools is designed for use by persons under eighteen (18) years of age. Therefore, for purposes of this COPPA Policy, “student” or “students” means a “child” or “children” under eighteen (18).

We provide tools for teachers and students to create animated videos. When a teacher uses our Services in the classroom or an educational setting to sign students up to GoAnimate, the teacher is required to provide consent to the collection, use, and disclosure of personal information from students and is required to affirm to us that they have the authority to do so.

Students’ personal information, as collected through this website and the GoAnimate for Schools platform, will be processed as described in this COPPA Policy, and in compliance with other applicable data protection laws. Use of our Site or Services, and any dispute over privacy, is subject to this COPPA Policy and our Terms of Service, including its applicable limitations on damages and the resolution of disputes. Our Terms of Service are incorporated by reference into this COPPA Policy.

Cross Border Transfers

We and our service providers use cookies and other tracking mechanisms to track information about our users’ use of our Site or Services. We or our service providers may combine this information with other personal information we collect from our users.

User-Generated Content

Users can create content on our Site or Services, such as by creating videos using the assets we provide and importing their own assets (such as image and audio files) for inclusion in these videos. Teachers control the sharing and distribution settings for the videos created by their students. If a user publishes his/her video on our Site or Services, the video and information contained within will be available to other users to the extent agreed upon between GoAnimate for Schools and the user’s teacher, classmates, school, district, or other similar person or entity. We cannot prevent such information from being used in a manner that may violate this COPPA Policy, the law, or our user’s personal privacy. If a teacher downloads or exports a video, the resulting video file does not reside on our Site or Services and is no longer governed by this Policy.

Our Site and Services may contain links to third-party websites. Any access to and use of such linked websites is not governed by this COPPA Policy but instead is governed by the privacy policies of those third-party websites. We are not responsible for the information practices of such third-party websites.

Security

We have taken steps to help protect the information we collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, no data security measures can guarantee 100% security. Users should take steps to protect against unauthorized access to their accounts by, among other things, choosing a robust password that nobody else knows or can easily guess and keeping their log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on an account because of unauthorized password activity.

In compliance with applicable law, we will notify governmental authorities of any data security breach within 72 hours of our becoming aware of the breach and, if it involves a high risk to your personal information, we will notify you as well.

Rights to Review, Delete, and Control Our Use of Students’ Personal Information

Teachers have a right to review the personal information we have collected about their students, to delete it, and to tell us to no longer use or disclose it. Teachers can review most of the personal information we collect about their students by logging in to their accounts and reviewing their account information and updating the personal information we maintain about their students. If a teacher does not want us to collect and use his/her student’s personal information anymore, then the teacher may cancel the student’s account and the student’s use of the Services.

Parents may also contact us at privacy-support@goanimate.com to request access to their child’s information or cancellation of their child’s account. After liaising with that child’s teacher, we will endeavor to honor a parent’s request.

Our computer systems are currently based in the United States, so your personal data will be processed by our service providers or us in the United States where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. If you create a user account with the Site as a visitor from outside the United States, by using the Site you agree to this COPPA Privacy Policy and consent to the processing of your personal data on servers outside your home country. We will take commercially reasonable measures to ensure that any such transfers of your personal data comply with applicable data protection laws and that your personal data remains protected to the standards described in this COPPA Privacy Policy. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal data.

Users and Residents in the European Union

Location of Systems
Our computer systems are currently based in the United States, so user’s personal data entered at our Site or related to the use of our services (i) will not be processed in the European Economic Area (EEA) and (ii) will be processed by our service providers or us in the United States and other non-EEA countries. By completing the registration and using the services, teachers who register their students (a) agree to and accept the terms stated in this COPPA Privacy Policy and (b) expressly consent to the processing of personal data on equipment and by service providers outside the European Economic Area.

Controller and Processor
GoAnimate is the Controller of data that you provide in order for us to create an account and provision the service for use. You are the Controller of any data that is entered during and as part of your use of the service and we are the Processor of that data on your behalf. We will process the data according to your instructions, which you give us in the process of signing up for the services, specifically to facilitate your use of the services.

Basis of Processing
If you reside in the European Union and we do not seek your explicit consent to process your personal data, we are relying on the legitimate commercial interest of our company in providing the services to you and other customers and the need to process your personal data as previously described in order to accomplish that legitimate interest. Where Data Processing is occurring based on the basis of your consent, you also have the right to withdraw consent and request that we halt processing at any time. This withdrawal of consent does not invalidate the consent-based processing that occurred prior to withdrawal.

Right to Review, Delete and Control our Use of Your Information
You have the right to request access to your personal information and may have additional rights depending on the personal data protection laws applicable to your jurisdiction.

You can review most of the personal information we collect about you by logging into your account and reviewing your account information and updating the personal information we maintain about you.

You may also contact our privacy officers at the address below, or email us at privacy-support@goanimate.com to request access to (i) review your personal information and (ii) exercise any of your rights with respect to your personal information, including erasure or deletion, and/or (iii) request cancellation of your account. Where we are the Controller of the data, we will respond to your request within one (1) month. Where we are the Processor of the data, you must contract the appropriate data Controller to exercise these rights.

Right to Take Your Information With You
You have the right to obtain a copy of your personal information and take it with you. The copy will be in a structured, commonly used and machine-readable format. If requested by you and when technically feasible, we will send that information via electronic means to a third-party designated by you, where we are the Controller of the information. Where we are the Processor of the data, you must contract the appropriate data Controller to exercise these rights.

Right to Remove Your Information
GoAnimate for Schools may store videos you have created on our platform or external assets you have imported into your asset library. You can delete such videos or assets at any time by logging into your account and using the deletion tools provided. Please note that such tools will only apply to the copies hosted by us and will not apply to videos previously downloaded or exported. Please also note that it may take up to one (1) month for such deletions to become permanent and irreversible.

In compliance with applicable United States federal and state laws, our privacy and security program has been built to protect your personal information, including training and awareness, monitoring and verification, and response and enforcement. We also keep records of how we process your personal information, and conduct regular analyses of our privacy and security practices.

Changes to this COPPA Policy

This COPPA Policy is current as of the Effective Date set forth above. We may change this COPPA Policy from time to time, so please be sure to check back periodically. We will post any changes to this COPPA Policy on our Site. If we make any changes to this COPPA Policy that materially affect our practices with regard to the personal information we have previously collected from users, we will endeavor to provide users with notice in advance of such change by highlighting the change on our Site.

Dear Teacher [Principal, School Administrator, etc.],

You wish to sign your students up to use GoAnimate for Schools, provided by GoAnimate, Inc. (“GoAnimate for Schools”, “we”, “us”, or “our”), which provides tools for teachers and students to create animated videos through our website goanimate4schools.com (the “Site”) and the services available through our Site (collectively, the “Services”).

We are required to provide you with this notice (“Direct Notice”) and obtain your consent to the collection, use, and disclosure of your students’ personal information pursuant to the Children’s Online Privacy Protection Act (COPPA).

While COPPA only applies to personal information collected from children under thirteen (13), GoAnimate for Schools is designed for use by persons under eighteen (18) years of age. Information We Collect Directly from Students. We collect the login credentials for students provided to us by teachers, which may include a student’s name or email address. If a student chooses to record his/her own voice in an animation or otherwise input information into our Services (e.g., text-to-speech language to help narrate a video), we also collect that student’s voice recording or other information.

Information We Collect Automatically. We may automatically collect the following information about students’ use of our Site through cookies and other technologies: domain name; browser type; browser language; device ID; operating system type; device name and model; pages or screens viewed; links clicked; IP address; when and the length of time a user visits or uses our Services; and the referring URL, or the webpage that led a user to our Site.

How We Use Students’ Information

We use students’ personal information to provide our Services, communicate with users, analyze use of our service, and to comply with the law.

How We Disclose Students’ Information

We disclose students’ personal information to other GoAnimate for School users (e.g., so students and teachers may message each other on our Site); to service providers who perform functions on our behalf; as part of a business transfer; in response to legal process; to protect us and others; and in the aggregate or in a de-identified format.

GDPR Compliance Notice

In order to fully comply with the General Data Protection Regulation (GDPR), which will go into effect in the European Union on May 25, 2018, GoAnimate, Inc. has modified its GoAnimate for Schools privacy policy. The change is intended to address enhanced requirements for parental consent in the EU under the GDPR. This notice is intended to highlight schools’ obligations to be sure proper consent has been obtained for all current and future students under the age of 18 that you have registered or will register on GoAnimate for Schools under your administrative and legal supervision, where necessary under the GDPR or other applicable data protection law.

When you register a student, you represent that you have obtained and verified valid consent for each student in accordance with the applicable data protection laws. You further acknowledge that, for purposes of the GDPR, you are the Controller with respect to any data of students that you send to GoAnimate, that GoAnimate is the Processor providing the services, and that you instruct GoAnimate to process the data consistent with the provision of the GoAnimate for Schools service. Finally, you acknowledge that GoAnimate may collect and process personal information from or about students, including name and email address, and you consent to the collection, use, and disclosure of students’ personal information by GoAnimate, Inc.,

Parental Consent For Student Registration and Processing Of Personal Data

For all current and future students under the age of eighteen (18) you have registered or will register on GoAnimate for Schools under your administrative and legal supervision, you make an ongoing representation and warranty to GoAnimate, Inc. that:

  1. You have the power, authority and parental consent required to enter into and perform the GoAnimate for Schools Terms of Service and this Notice on behalf of your school;
  2. You shall comply with the GoAnimate for Schools Terms of Service and this Notice, and have complied with your school’s requirements for obtaining parental consent and all applicable laws;
  3. You have obtained lawful permission from students parents/guardians as required to consent to the registration of your students for purposes of using GoAnimate for Schools;
  4. You have obtained valid parental consent for the sharing and processing of your students personal information;
  5. In obtaining this parental consent, you have provided to the custodial parent(s) or guardian(s) (a) all relevant information on the manner and frequency with which such student shall be granted access to GoAnimate for Schools and (b) detail of the student’s personal information that will be disclosed to GoAnimate, Inc. for use of GoAnimate for Schools and (c) the GoAnimate for Schools Terms of Service and Privacy Policy provided by GoAnimate, Inc. which will govern the collection and processing of the student's information and student’s use of GoAnimate for Schools;
  6. All information provided by you to GoAnimate, Inc., including, without limitation, your school’s name and address; your legal name, email address and phone number; and student registration information, is truthful, accurate and complete;
  7. From the date of this notice forward, you shall only register students in compliance with this policy.

You or the appropriate administrator of your school shall assure that records of such parental consents will be retained by the school in written form. Upon request by GoAnimate, Inc. you will present such documentation to allow GoAnimate, Inc. to demonstrate compliance with applicable data protection law. The foregoing representations here are made with the knowledge that GoAnimate, Inc. will rely on them in effecting its compliance with applicable data protection law.
