California Privacy Statement

This California Privacy Statement (this "Statement") is made by GoAnimate, Inc. ("GoAnimate") in order to evidence GoAnimate's compliance with Section 49073.1 of the California Education Code (formerly California Assembly Bill 1584) (the "CA Act"). This Statement forms a part of GoAnimate's Privacy Policy to the extent any customer or student is covered by the CA Act. All capitalized terms used in this Statement that are not otherwise defined herein shall have the meanings given to such terms in the CA Act.

(1) Pupil Records continue to the property of and under the control of the Local Educational Entity.

(2) Notwithstanding paragraph (1) the following is a description of the means by which pupils may retain possession and control of their own pupil-generated content, if applicable, including options by which a pupil may transfer pupil-generated content to a personal account:

Step 1: An authorized requestor should send an email to support@goanimate4schools.com with the following information:
Subject: Request transfer of student information
Content: The email should contain the specific information to be transferred and the authority under which the requester is acting.

In order to generate an appropriate paper trail, this email is required. Action will not be taken based on a phone call or a live chat.
Step 2: A Customer Success Associate will validate the person's authority to take the action requested. An authorized requestor is any one of the following:
  • The Super Teacher on the account.
  • An active Teacher on the account.
Step 3: Once the requestor's authority to act has been confirmed, the Customer Success Associate will take the action requested.

(3) GoAnimate shall not use any information in the Pupil Record for any purpose other than those required or specifically permitted by the contract between GoAnimate and the Local Educational Entity.

(4) The following is a description of the procedures by which a parent, legal guardian, or eligible pupil may review personally identifiable information in the Pupil Record and correct erroneous information:

A student, parent, or legal guardian may review and correct personally identifiable information (PII) covered under the CA Act by contacting the Super Teacher on the GoAnimate for Schools account. The Super Teacher will either take the requested action directly, or seek assistance from GoAnimate.
Step 1: If the Super Teacher chooses to ask GoAnimate to assist, he or she should send an email to support@goanimate4schools.com with the following information:
Subject: Request review or change to student personally identifiable information
Content: The email should contain:
  • The name of the student
  • The GoAnimate username of the student
  • The specific information to be reviewed, and/or corrected
Step 2: A Customer Success Associate will validate that the requestor is the Super Teacher on the account.
Step 3: Once the requestor's authority to act has been confirmed, the Customer Success Associate will take the action requested.

(5) The following is a description of the actions GoAnimate will take, including the designation and training of responsible individuals, to ensure the security and confidentiality of Pupil Records. Compliance with this requirement shall not, in itself, absolve GoAnimate of liability in the event of an unauthorized disclosure of Pupil Records:

GoAnimate will train all support personnel on their responsibilities, as outlined in this Privacy Policy, and conduct refresher training annually.

(6) The following is a description of the procedures for notifying the affected parent, legal guardian, or eligible pupil in the event of an unauthorized disclosure of Pupil Records:

As soon as feasible, but not more than 30 days after the discovery of a breach, GoAnimate will call the Local Educational Entity impacted, and also send an email to the Super Teacher of impacted accounts and to the affected parent, legal guardian, or eligible pupil.

(7) GoAnimate certifies that Pupil Records shall not be retained or available to GoAnimate upon completion of the terms of the contract, and the following is a description of how that certification will be enforced; provided, however, that the foregoing shall not apply to pupil-generated content if the pupil chooses to establish or maintain an account with the third party for the purpose of storing that content pursuant to paragraph (2).

Pupil Records shall not be retained or available to GoAnimate upon completion of the contracted services unless a student, parent or legal guardian of a student chooses to establish or maintain an electronic account with GoAnimate for the purpose of storing student-generated content.
When a GoAnimate for Schools subscription expires, student records and all student-generated content will be permanently deleted after 365 days, unless a request is made from the Super Teacher to permanently delete the information sooner. All such requests will be acted upon within 30 days.
If a student, parent, or legal guardian of a student makes a request to establish or maintain an electronic account for the purpose of storing student-generated content, GoAnimate will help them purchase a new subscription following normal processes.

(8) The following is a description of how the local educational agency and GoAnimate will jointly ensure compliance with the federal Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g):

GoAnimate will only disclose student information covered by the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g), in keeping with this Privacy Policy, and will require compliance from local educational agencies when relevant information is requested.

(9) GoAnimate shall not use personally identifiable information in Pupil Records to engage in targeted advertising.
